1. Personal Information we collect

a.    Personal Information you provide to us. Many areas and features on our Services do not require registration and may be accessed by you without having to disclose any Personal Information. However, to the extent you voluntarily provide your Personal Information to us, we collect such Personal Information. For example, we collect Personal

1. When you register to become a member on our Services (in such event, we collect your first and last name, email address, password, country of residence, and commercial information, such as Cricut products purchased).
2. When you register to participate in an event, contest, or sweepstakes (in such event, we collect your first and last name, email address, phone number, and mailing address).
3. When you join our electronic mailing list (in such event, we collect your first and last name and email address). If we send you emails, we may track whether you open them to learn how to deliver a better customer experience and improve our Services.
4. When you purchase a product or service from us online (in such event, a third-party service provider that handles payments for us collects your credit card, bank account, or other payment account information in order for us to
   accept, process, manage, and fulfill a purchase order as well as to process a return and refund request from you after the purchase).
5. When you submit a request or inquiry to us (in such event, we collect details regarding your interactions with our support team, such as the date, time, and reason for contacting us, transcripts of any chat conversations, and if you call us, your phone number).
6. If you decide to apply for a job with us, you may submit your contact information and your resume online. We will collect the Personal Information you choose to provide us as part of your job application, such as your contact information, education, and employment experience. If you apply for a job with us through a third-party platform, we will collect the Personal Information you make available to us through such third-party platform.

c.    Personal Information we receive from third parties.

1. You may also post photos, comments, or reviews on our pages available through third-party platforms, including Facebook, Twitter, Pinterest, or Instagram. b.    Disclosure to Co-Sponsors. From time to time, we may co-sponsor (online and offline) events and/or product/service offerings with non-affiliated third parties. If you participate in such co-sponsored events or offerings, any Personal Information we collect from you based on your participation may be shared with our co-sponsors who may use such Personal Information for their own marketing and advertising purposes.

Doing so by way of your Cricut account settings happens systematically, whereas doing so via e-mail may require identity verification and will be processed as soon as possible after receipt. Notwithstanding the above, we reserve the right to retain your Personal Information if doing so is required by law or to comply with legal process (including a court order or subpoena), a legitimate law enforcement need, or for legitimate business purposes.

5. Data Retention

We make it a priority to protect your Personal Information and to use it in the way our members would expect us to. Your Personal Information is retained to allow for financial transactions and to allow Creative Newtech to provide our Services for up to 5 years after you have actively engaged with our Services, or until you request otherwise, unless we are required by law to keep this Personal Information for a longer period. When determining the specific retention period, we take into account various criteria, such as the type of service provided to you, the nature and length of our relationship with you, and mandatory retention periods provided by law and the statute of limitations.

Creative Newtech understands the importance of protecting the security and integrity of Personal Information shared with us and will endeavour to safeguard your Personal Information. It is also important for you to protect against unauthorized access to your password and to your computer. We urge you to keep your account login information in a safe place and not to divulge it to anyone. Also, remember to sign off your account and close your browser window when you have finished your visit. This is to ensure that others cannot access your account, especially if you are sharing a computer with someone else or are using a computer in a public place such as a library or an Internet cafe.

INTERNET SALES POLICY

Cricut’s Internet Sales Policy is to sell Cricut products through Cricut authorized online sellers only. No person or business is authorized to sell via the Internet without express contractual agreement with Cricut. Authorized Cricut resellers have access to the entire Cricut line and are able to answer product or warranty questions. Purchasing a Cricut through an authorized seller means that you receive:

a.    – A GREAT product that is sure to provide you with years of enjoyment

b.    – The support of and assistance from our representatives in helping you with your selections/questions

c.     – A superb warranty should you ever need it

d.     – Excellent value for your money

• Estimated Delivery Time: Please allow 7-12 business days for delivery of your order within the Indian Subcontinent.

Internet Return Policy for the Indian Subcontinent:

• Return Initiation: If you wish to initiate a return, please contact our support team at [email protected] within three days of receiving your order.
• Return Deadline: Returns will not be accepted after 15 days from the date of receiving your order.
• Exceptions: Please note that we do not offer returns on opened Cricut Cartridges or Digital content.
• Return Condition: Any items you wish to return must be in saleable condition and in their original, unopened packaging.
• Return Shipping: Return shipping costs are the responsibility of the customer, unless you have received a damaged or incorrect product.
• Damaged Products: In the event that you receive a damaged product, please reach out to our customer service at +91-897-695-3741 for assistance.
• Return Authorization (RMA): For all returns, you will need to obtain a Return Merchandise Authorization (RMA) number. Returns without an RMA will not be accepted. Kindly contact our support team to request an RMA. Once you have received an RMA, your returns must be received within 14 days.

Shipping Information:

1.  Processing Time: Orders typically require 5-7 business days for processing before they are shipped out. Please note that during peak seasons or special promotions, processing times may be slightly longer.

Returns and Refunds:

Exceptions:

• Customized or personalized items are not eligible for returns unless they arrive damaged or defective.
• Clearance or final sale items are not eligible for returns.

Exchanges:

We currently do not offer direct exchanges. If you wish to exchange an item for a different size or colour, please initiate a return and place a new order for the desired item.

Cricut: One (1) Year Limited Warranty

Your Cricut Machine (Product) is guaranteed against defects in materials and workmanship

for a period of one (1) year from the date of its original retail purchase (“Warranty Period”). If a

defect arises during the Warranty Period, Creative Newtech Limited, at its option, will (1) repair the product at no charge using new parts or parts that are functionally equivalent to new in performance, (2) exchange the Product with a functionally equivalent Product that is new or equivalent to new in performance, or (3) refund the original purchase price. This warranty excludes damage from abuse, accident, misuse, physical and/or software modifications or other causes that are not defects in materials and workmanship. Exposure to a temperature in excess of one hundred and ten degrees Farenheit (110’F) voids this warranty. Any recovery is limited to the original purchase price. No other person/entity may modify this limited warranty, and your retail seller is solely responsible for any other warranties.

This Warranty applies to the Cricut machine. It does not apply to blades and blade housings, accessories, packaging, software, tools, materials, or other non- machine items. Creative Newtech Limited does not guarantee or warrant uninterrupted use of the Product or its supporting software.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, CRICUT IS NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR SERVICE OF THE CRICUT MACHINE. THE WARRANTY AND REMEDIES DESCRIBED ABOVE ARE EXCLUSIVE OF ANY OTHER WARRANTIES AND REMEDIES, WHETHER ORAL, WRITTEN, EXPRESS, STATUTORY OR IMPLIED. TO THE EXTENT PERMITTED BY APPLICABLE LAW, CRICUT DISCLAIMS ALL IMPLIED AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ALLOWED AND DISCLAIMED WARRANTIES ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state and country to country, where some limitations or exclusions are not allowed under local laws. This may include the length of the warranty. This warranty only applies to the country of the Product’s intended sale.
